"RESOLVED, That the Site Plan Application for 24 Olive Street, Portofina's Restaurant be

"RESOLVED, That Report P.A. 11-33, regarding revisions to applications for Zoning Amendment and Vacant Land Condominium 288 Main Street East be received, and that; 1. The draft plan of Vacant Land Condominium be approved, subject to the conditions attached to this report as Appendix "A"; 2. That the following additional conditions be included: a) That the draft plan be modified to increase the width of Lot 4 or reduce the building envelope proposed for Lot 4 to accommodate additional plantings on the east side of the property; Page 4 of 8 Planning & Development September 13, 2011 b) That the owner enter into a site plan agreement with the Town of Grimsby to satisfy all requirements including but not limited to architectural design, tree preservation, fencing and compatibility. 3) That the draft zoning by-law be amended in accordance with the requested revisions including that Section 2 (f) be revised to include maximum heights for 1 1/2 storeys for lots 2 to 9 and 2 storey for Lot 1, and be forwarded to Council for approval following the submission of a draft condominium plan and surveyor's confirmation that all lots and blocks conform to the approved zoning." 4) Awareness of proximity to lighting and the church be included as a condition of sale and that said Appendix be forwarded to Council for approval.

"RESOLVED, That P.A. 11-31, regarding proposed revisions to zoning amendment and draft plan of subdivision applications for 381 Murray Street, be received and that the applications be approved as revised and that: 1. The draft plan of subdivision be approved, subject to the conditions attached as Appendix "A" to Report P.A. 11-27, as amended to reflect the revised plan; and that the height of lots 11 and 12 be limited to 1 1/2 storey and that second storey windows on lots 14, 15 and 24 be restricted on the second floor north side and; Page 6 of 8 Planning & Development September 13, 2011 2. That the draft zoning by-law amendment attached as Appendix "B" to the Report P.A. 11-27, as amended, be forwarded to Council for approval following the submission of a draft 30M plan and surveyor's confirmation that all lots conform to the approved zoning."

"RESOLVED, That Report P.A. 11-32, Zoning By-law Amendment No. 71- 74, Trailer By-law be received; AND THAT, Staff be directed to proceed with the process to amend the definition of Trailer in By-law No. 71-74, as amended, to conform with the definition of trailer as it appears in the Ontario Highway Traffic Act, R.S.O. 1990, Chapter H8, Consolidation Period from July 17, 2011."
