Resolved that Minor Variance Application A06-26 for 10 Mountain Street, to permit a maximum rear yard encroachment of 6.5 metres, whereas a maximum rear yard encroachment of 1.5 metres is permitted according to Section 4.9 (c), in Zoning By-law 14-45, as amended be approved with conditions. 1. The proponent is to ensure that the lots of 10 Mountain Street and 12 Mountain Street are merged prior to the approval of a building permit and/or or site plan approval that depicts work occurring across property boundaries of the parcels, which can be identified by the PINs of 46022 – 0065 and 46022-0066, respectively. 2. The Owner shall obtain Site Plan Approval from the Town of Grimsby if the subject lands are to be modified to construct additional parking spaces; change the parking lot entrance; and/or a combination of works that will materially alter the existing lot grading and drainage.
