Resolved that Submission A10-21, 25 Margaret Avenue by David & Holly Gibson be approved with conditions: 1. The Public Works Department requires confirmation that the easement has been removed from title. 2. That a Niagara Peninsula Conservation Authority (NPCA) work permit be obtained by the applicant, and that the NPCA’s conditions of approval are addressed: • The NPCA will be required to review a topographic survey that establishes the limits of the floodplain on the property at 82.63 metres GSC. Page 4 of 6 Committee of Adjustment April 20, 2021 • Should any works (including the pool, patio, and lot grading) be within the floodplain limit, the NPCA would require confirmation that encroachment is less than 50 cubic metres. • Should any works encroach within 10 metres of the watercourse, a report from a qualified professional is required to support an environmental l Impact Study (EIS) may also be required. • That a NPCA Work Permit is issued by the NPCA prior to the commencement of works on site.
