Whereas Council requires complete, objective and timely information on planning matters, including Ontario Land Tribunal (OLT) appeals, to make fully informed and thorough decisions; and Whereas failure to bring required planning applications before Council for a decision within the prescribed statutory timelines can and has resulted in OLT appeals for “non-decision”; and Whereas upon the Town having received OLT appeals, there has been instances of significant delay in notifying Council of these important legal matters. Therefore, be it resolved that upon the receipt of an initial development application, Town Staff are directed to notify relevant Ward Councillors of the application in a timely manner; and That in the event that a development application cannot be brought before Council for a decision before the statutory Planning Act deadline, Town Staff are directed to notify Council at the earliest opportunity prior to that deadline; and That upon the receipt of any OLT appeal, Town Staff are directed to provide Council at its next regularly scheduled meeting, a brief information report on the appeal; And further that as prospective “non-decision” events on complete planning applications and OLT appeals constitute potential or actual legal proceedings against the municipality, that these reports and information be considered in closed session only.
