"RESOLVED, That the minutes of the Committee of Adjustment meeting of September 29, 2009 be approved as circulated.

"RESOLVED, That Submission A-16/09 by Walter Vanderkolk, for a Minor Variance from the provisions of By-law 71-74, as amended, Section 8, Rural RU Zone, to allow for the renovation of an attic into a second floor with a rear yard setback of 11.2 metres in a Rural RU Zone at # 489 Allen Road, Grimsby be granted for the following reasons: 1. The Variance is minor in nature. 2. The intent of the Official Plan and Zoning By-law is maintained. 3. The proposal is desirable for the appropriate development of the land."

"RESOLVED, That Submission A-17/09 by Robert Aitchison, for a Minor Variance from the provisions of By-law 71-74, as amended, Section 17, Transitional Residential Multiple Zone, to legalize a recently constructed accessory building with a lot coverage of 8.3% in a Transitional Residential Multiple (TRM) Zone at # 30 Murray Street, Grimsby be approved with conditions for the following reasons: 1. The Variance is minor in nature. 2. The intent of the Official Plan and Zoning By-law is maintained. 3. The proposal is desirable for the appropriate development of the land." Subject to the following conditions: a. That the Southerly second floor addition remain open and unenclosed on all three sides at grade level to the underside of the floor joists of the second floor.
