Resolved that the minutes of the Committee of Adjustment meeting of August 18, 2015 be approved as circulated.

Resolved that Submission A-25/15 by Gurlabh Sidhu, for a Minor Variance of the provisions of By-law 14-45, Downtown Main Street (DMS) Zone Section 8, to allow for the re-construction of a gas station providing 9 parking spaces in the Downtown Main Street (DMS) Zone at # 88 Main Street West, Grimsby be approved with conditions for the following reasons: Page 3 of 5 Committee of Adjustment September 15, 2015 1. The Variance is minor in nature. 2. The intent of the Official Plan and Zoning By-law is maintained. 3. The proposal is desirable for the appropriate development of the land. Subject to the following conditions: 1. That the applicant enter into a site plan agreement with the Town of Grimsby.

Resolved that Submission A-26/15 by George & Donna Warkentin, for a Minor Variance of the provisions of By-law 14-45, Main Street (MS.35) Zone Section 7 (By-law 11-13), to allow for the construction of a new 2 storey dwelling with a westerly interior sideyard setback of 1.0 metre for the one storey garage projection in a Main Street (MS.35) Zone at # 241 Main Street East, Grimsby be approved with conditions for the following reasons: 1. The Variance is minor in nature. 2. The intent of the Official Plan and Zoning By-law is maintained. 3. The proposal is desirable for the appropriate development of the land. Subject to the following conditions: 1. That the mature trees at the front of the property are retained to maintain the streetscape.

Resolved that Submission B-07/15 by Brian Mielko for consent to convey be granted as per the Notice of decision.
