Whereas Section 223.2(1) of the Municipal Act, 2001, S.O. 2001, c 25, authorizes a municipality to establish codes of conduct for members of Council of the municipality and of local boards of the municipality; and Whereas the Town of Grimsby established By-Law 20-74 to establish such codes of conduct; and Whereas the Town of Grimsby and its taxpayers have incurred excessive integrity commissioner costs exceeding budget requirements in its 2018- 2022 term as a result of formal integrity commissioner complaints among members of council; and Whereas an Informal Complaint Process is noted in By-Law 20-74 and offers similar benefits of dispute resolution as an informal complaint but with minimal expenses; and Whereas By-Law 20-74 encourages individuals to pursue the informal complaint procedure as a means of stopping and remedying the behaviour of activity that is inconsistent with the Code of Conduct. However, it is not a precondition or prerequisite that the complainant pursue the Informal Complaint Procedure prior to pursuing the Formal Complaint Procedure. Therefore be it resolved that Council Members make all reasonable efforts to file an informal complaint prior to filing a formal complaint, wherever possible. Whereas the Town of Grimsby provides public transportation to its residents through NRT on Demand; and Whereas NRT on Demand is a well-used service by members of our community, particularly those unable to drive; and Whereas NRT on Demand is often used by Grimsby residents for medical appointments which require consistent, reliable pickups and drop offs; and Whereas NRT on Demand riders have often reported late or cancelled pickups and drop-offs, difficulty booking rides verbally or in a simple accessible format, and not having accessible tools provided for those in need (i.e. Ensuring a metal stool is available for those at the curb); and Whereas Grimsby Residents using NRT on Demand expect and require consistent, reliable, and accessible transportation when booking services. Therefore, be it resolved that the Town of Grimsby communicate to Niagara Regional Transit the immediate changes necessary to ensure consistent, reliable, and accessible transportation for Grimsby residents, especially those using the service for important appointments.
