RESOLVED, That Report DPW12-04 dated January 25, 2012 regarding the ‘Annual Drinking Water Systems Report (2011) for the Grimsby Water Page 2 of 7 Public Works Committee February 15, 2012 Distribution System and Calder Community Centre Cistern’ is hereby received by Town Council.

RESOLVED, That Report DPW12-05 dated January 25, 2011 regarding the ‘Annual Municipal Summary Report (2011) for the Grimsby Water Distribution System’ is hereby received by Town Council.

RESOLVED, that Report DPW12-06 dated January 26, 2012 regarding ‘Annual Drinking Water Quality Management System (DWQMS) Infrastructure Review Report (2011) for the Grimsby Water Distribution System’ is received by Town Council for review and information.

Page 3 of 7 Public Works Committee February 15, 2012 Resolved that Report DPW12-01 dated January 16, 2012 regarding Town Hall Reconstruction – Gas Tax Fund Financing be received and that previously approved Resolution PW11-02 hereby be amended to read that the additional Town Hall costs be funded by the Town’s Capital Projects Reserve Fund and not from the Gas Tax Reserve.

RESOLVED, That Report DPW12-02, dated January 23, 2012, regarding Lifting of Reserves and Dedication as Public Highways on Town 0.30m Reserves being Block 26 and Block 27 on Plan 30M-271 and Block 40 and Block 41 on Plan 30M-202 be received; and the Mayor and Town Clerk be authorized to sign a By-Law dedicating Block 26 and Block 27 on Plan 30M-271, and Block 40 and Block 41 on Plan 30M-202 as Public Highways; and further, that the By-Law be registered under The Land Titles and Registry Office.

RESOLVED, That Report DPW12-03, dated January 25, 2012, regarding the Final Payment and the Release of the 10% Construction Lien Hold Back for Contract PWC10-06-440023 Garden Drive, Oriole Crescent, Vinewood Avenue, Murray Street, Old Orchard Avenue, Whittaker Avenue and Page 4 of 7 Public Works Committee February 15, 2012 Christie Street/Main Street West Watermain Replacement Project be received and that the Director be authorized to release the Final Payment and 10% Construction Lien Hold Back in the amount of $95,695.74; and, further be authorized to release the 2% One-Year Maintenance Hold Back in the amount of $18,935.29 when the one-year maintenance period expires on October 18, 2012, in favour of Cotton Inc.

RESOLVED that Report DPW12-07 dated February 2, 2012 regarding the Drainage Petition – Flooding of the west road side ditch on Woolverton Road between Mud Street and the Forty Mile Creek Municipal Drain be received and that the Director be authorized to proceed with the Preliminary Drainage Report in accordance with the requirements of The Drainage Act, and further , that the firm of Spriet Associates London Limited be retained to carry out the Preliminary Drainage Report for their estimated fee of $8000.00.

RESOLVED that Report DPW12-08, dated February 2, 2012 regarding the Drainage Petition for the flooding of the road side ditches on Ridge Road East for approximately 275 metres west of Church Road – be received and that the Director be authorized to proceed with the Preliminary Drainage Report in accordance with the requirements of The Drainage Act, and Page 5 of 7 Public Works Committee February 15, 2012 further, that the firm of Spriet Associates London Limited be retained to carry out the Preliminary Drainage Report for their estimated fee of $3,500.00.

RESOLVED, That Report DPW12-09 dated February 7, 2012 regarding the Final Payment and Release of the Ten Percent Construction Lien Hold Back and the Two Percent One-Year Maintenance Hold Back for Contract PWC11-02-320002, Hot Mix Paving Program 2011 & Town Hall Entrance Construction Contract be received, and that the Director be authorized to release the Final Payment and the Ten percent Construction Lien Hold Back in the amount of $59,569.62 and further release the Two Percent One Year Maintenance Hold Back in the amount of $5,794.83 when the one-year maintenance period expires on November 10, 2012, in favour of A-1 Asphalt Maintenance Ltd.

Resolved that the correspondence received from the Grimsby Farmer's Market Steering Committee members dated December 28, 2011 be received and that the Farmer's Market in the downtown area between Christie Street Page 6 of 7 Public Works Committee February 15, 2012 and Ontario Street be permitted by Grimsby Town Council subject to an annual Region of Niagara permit.

Resolved that the GDIA annual general meeting minutes of December 8, 2011 be received for information and filed.
