Resolved that the minutes of the meeting held on June 15, 2021 be approved.

Resolved that the minutes of the meeting held on June 29, 2021 be approved.

Resolved that Michaela Bray be appointed Assistant Secretary/Treasurer for the Committee of Adjustment be approved.

Resolved that the application B03-21 by Monique Hubert regarding the lands known as Part 1, Plan 30R-12978 for consent to sever 87.3 sq. m. of land shown as "Lands to be Severed" on the circulated sketch which are to be merged with the abutting lands to the east for future residential use (subject of application B04-21) and to retain 2027.4 sq. m. of land shown as "Lands to be Retained" on the circulated sketch for future residential use be approved with conditions.

Resolved that application B04-21 by Marc Hubert regarding Part 2, 30R 12978 for consent to sever 1281.7 sq. m. of land shown as "Lands to be Severed" on the circulated sketch for future residential use and to retain 1230.2 sq. m. of land shown as "Lands to be Retained" on the circulated sketch which are to be merged with the abutting property to the west (subject of application B03-21) for future residential use be approved with conditions.

Resolved that Submission A05-32 by Giancarlo & Sabrina DiCarlo to increase the lot coverage to 19.82% whereas 15% is allowed and to increase the building depth to 27.99m, whereas 20m is allowed be approved with conditions.

Resolved that Submission A18-21 by Katharine Richardson for 38 Oak Street, to permit a rear yard setback of 4.78m whereas 9m is required, be approved.

Resolved that Submission A19-21 by Leroy Crooks for 57 Peach Tree Lane, to permit a secondary suite solely within a cellar, whereas By-law 14-45, as amended, states that a secondary suite it permitted as long as it is not solely within a cellar be approved with conditions.

Page 7 of 8 Committee of Adjustment July 20, 2021 Resolved that Submission A20-21, by Stephen & Cathy Brown for 40 Stewart Street, to permit an interior side yard setback of 1.2m whereas 1.8m is required and to allow the encroachment of a front porch by 2.56m whereas 1.5m is permitted be approved.

Resolved that Submission A22-21 by District School Board of Niagara c/o Dave Boyd for 18 Oakes Road North, to request extension of the asphalt parking lot to the property line, whereas a 3m buffer from the property line to the parking area is required, be approved.

Resolved that Submission A23-21 by SMR Investment Holding Inc. for 264 Main Street East to allow for the reduction in parking to 30 parking spaces where as 43 are required be approved with conditions.
