Resolved that the Council meeting minutes of July 21, 2014 be approved.

Resolved that the Committee of Adjustment meeting minutes of July 29, 2014 be received and filed.

Resolved that the Administration & Finance Committee meeting minutes of August 11, 2014 be approved.

Resolved that Resolution PW-14-47 in the Public Works Committee Page 3 of 9 Council August 18, 2014 Minutes of August 13, 2014 regarding the 2014/2015 Water Meter Replacement Project be lifted from the minutes for separate consideration.

Resolved that Report DPW14-35 dated August 8, 2014 regarding 2014/2015 Meter Replacement Project be received and that a proposed $1,287,975.00 contract (excluding HST) and that Provisional Items estimated at 5% ($64,400.00) be received that the proposed contract with Neptune Technology Group (Canada) Ltd. for the Turnkey replacement of 3,963 Town water meters be approved and the Mayor and Town Clerk be authorized to execute the contract and further that "Provincial Item - (g)" costs assessed to the Town by Neptune for a failure to comply by the homeowner be charged back to the homeowner's water bill, subject to review by the Director of Public Works.

Resolved that the Public Works Committee meeting minutes of August 13, 2014 be approved.

Whereas By-law 09-60 being a by-law to imposed development charges in the Town of Grimsby expires on August 31, 2014; Page 4 of 9 Council August 18, 2014 And whereas a Development Charges Background Study was completed on July 4, 2014 with Addendum Number 1 completed on August 12, 2014; Therefore it be recommended that Report P.A. 14-40 regarding the 2014 Development Charges Background Study and By-law be received; And that the Development Charges Background Study dated July 4, 2014 with Addendum Number 1, dated August 12, 2014 be approved; And that the Development Charges By-law No. 14-84 be passed to take effect at 12:01 a.m. on September 1, 2014.

Resolved that the Southward Community Park Tender Opening Report DRS14-15 be received and that the tender in the amount of $2,377,703.35 plus applicable taxes for contract RFC2014-01 Earthworks, Grading, Seeding, Irrigation Pond, Roadways, Parking Lots and Pathways from V. Gibbons Contracting Ltd., be accepted and further that the Mayor and Town Clerk be authorized to sign the necessary contract documents.

Resolved that the Director of Public Works be authorized to advise the Region of Niagara that the Town wishes to upgrade the new Livingston Avenue/Roberts Road traffic signals to decorative at an estimated costs to the Town of $18,000 and that this funding be obtained from the Public Works Capital Reserve.

Resolved that a “temporary” All Way Stop be approved at the intersection of Winston Road / North Service Road / Hunter Road as an interim measure to accommodate this unique intersection; whereby the major roadway (North Service Road) is not the through road, until the Town’s 2015 Traffic signals and Intersection construction works at this intersection are completed; and further, that the Mayor and Clerk be authorized to sign a By-law to modify the Town’s Traffic By-law 89-2000 as follows: 1. Delete from Schedule “N” (Through Highways): Highway From To Winston Road East side of Oakes a point 350 metres Road East of Hunter Road 2. Add to Schedule “N” Highway From To Winston Road East side of Hunter A point 350 metres Road East of Hunter Road 3. Add to Schedule “p” (Stop Sign Locations): Winston Road Hunter Road East Bound Hunter Road Winston Road South Bound North Service Road Winston Road North Bound North Service Road Hunter Road West Bound Page 6 of 9 Council August 18, 2014

Resolved that leave be given to introduce By-law Nos. 14-77 to 14- 89 inclusive and that the same be read a first time.

Resolved that Council meet in Closed Session under Sec. 239 (2)(e) Litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board -Ontario Municipal Board Appeals Grimsby Zoning By-law

Resolved that Council return to Open Session.

Resolved that Planning & Development Committee meeting minutes of August 12, 2014 be approved.

Resolved that leave be given to introduce By-law Nos. 14-77 to 14- 89 inclusive read a first time be now read a second and third time and finally passed; that the Mayor and Town Clerk do sign and seal the same any rule of Council to the contrary notwithstanding.
